ITR-5 Return Filing – For Trusts, AOPs, BOIs & Non-Corporate Entities
The Income Tax Department has prescribed different return forms based on the nature of the taxpayer and source of income. One such return is Form ITR-5, which is used by entities that are not classified as companies, yet are required to file income tax returns in India.
ITR-5 is primarily applicable to firms, trusts, Associations of Persons (AOPs), Bodies of Individuals (BOIs), and similar entities that do not fall under the corporate tax framework but must still report their income, tax liability, and compliance details to the Income Tax Department.

- Partnership Firms
- Limited Liability Partnerships (LLPs)
- Association of Persons (AOP)
- Body of Individuals (BOI)
- Trusts and Investment Funds
- Business Trusts
- Cooperative Societies
- Local Authorities

Important Exclusion
Entities that are required to file returns under Sections 139(4A), 139(4B), 139(4C), or 139(4D) of the Income Tax Act cannot use ITR-5 and must file the appropriate return prescribed for their category.
Who Is Not Eligible to File the ITR-5 Form?
The ITR-5 form is not applicable to certain categories of taxpayers. The following entities and individuals must use other prescribed return forms instead of ITR-5:
Individuals
Individual taxpayers are required to file income tax returns using forms applicable to their income profile, such as ITR-1, ITR-2, or other relevant forms.
Hindu Undivided Families (HUFs)
HUFs cannot use ITR-5 and must file returns using forms suitable to their income sources, commonly ITR-2 or other applicable forms.
Companies
Companies are required to file their returns using company-specific forms, such as ITR-6, except those claiming exemption under Section 11 of the Income Tax Act.
Taxpayers Required to File ITR-7
Entities or persons falling under Sections 139(4A), 139(4B), 139(4C), 139(4D), 139(4E), or 139(4F) must file their returns using Form ITR-7. These provisions generally apply to charitable trusts, political parties, educational institutions, research institutions, and similar entities.
No Document Attachment Required with ITR-5
The ITR-5 return is an annexure-less form, meaning taxpayers are not required to attach or upload any supporting documents while filing the return. However, relevant records should be maintained for future reference or verification if required by the tax authorities.
Structure of the ITR-5 Form
The ITR-5 form is organised into multiple parts and schedules to ensure detailed reporting of financial information, income, deductions, and tax liability.
Part A – General Information
This section captures basic details of the taxpayer, including name, PAN, address, and contact information.
Part A – BS (Balance Sheet)
This part requires disclosure of the entity’s balance sheet, reflecting its financial position as on the specified date.
Part A – Manufacturing Account
Details related to the manufacturing account for the relevant financial year are reported in this section.
Part A – Trading Account
This section records information relating to the trading activities carried out during the financial year.
Part A – P&L (Profit and Loss Account)
Here, the taxpayer reports income and expenses for the year, resulting in the net profit or loss.
Part A – OI (Other Information)
Additional financial and compliance-related information relevant to the return is disclosed in this section.
Part A – QD (Quantitative Details)
This part captures quantitative details related to production, turnover, or other specified parameters, where applicable.
Part B – Computation of Total Income and Tax
Part B is a crucial section where the total income is computed and the applicable tax liability is calculated.
Schedules in the ITR-5 Form
The ITR-5 income tax return consists of multiple schedules designed to capture detailed financial information of the taxpayer. In total, the form contains 31 schedules, sections, or categories that collectively present a complete picture of income, deductions, and tax liability.
These schedules cover a wide range of financial aspects, including:
- Income from various sources
- Allowable deductions and exemptions
- Depreciation details
- Capital gains
- Foreign income and assets
- Other statutory disclosures
Taxpayers are required to complete only those schedules that are relevant to their financial situation. Each schedule serves a specific purpose in structuring and reporting information accurately to the Income Tax Department.
Part B – TI: Computation of Total Income
In Part B – TI, the taxpayer calculates the total income after consolidating details furnished across the applicable schedules. This section summarizes income under different heads and arrives at the final taxable income figure.
Part B – TTI: Computation of Tax on Total Income
This section deals with the calculation of tax liability based on the total income computed in Part B – TI. Applicable tax rates, cess, rebates, and other adjustments are applied to determine the final tax payable.
Details of Tax Payments
The ITR-5 form also requires disclosure of taxes already paid, which includes:
- Advance tax payments
- Self-assessment tax payments
- Tax Deducted at Source (TDS) on income other than salary (Forms 16A, 16B, and 16C)
- Tax Collected at Source (TCS), wherever applicable
These details help adjust the final tax liability and determine whether any tax is payable or refundable.
Recommended Sequence for Filling the ITR-5 Form
The Income Tax Department advises taxpayers to follow a structured sequence while completing the return to avoid errors and omissions:
- Part A – General and financial information
- Schedules – Detailed income, deduction, and computation schedules
- Part B – Computation of total income and tax liability
- Verification – Final confirmation and submission of the return
Following this order ensures accurate computation and smooth filing of the ITR-5 return.
